2600 MHz (2010) Notice regarding collusive behavior
Austrian regulatory authority advises of regulations prohibiting collusive behavior in 2.6 GHz frequency assignment procedure
In connection with the ongoing procedure (F 4/08) for the assignment of frequencies in the 2.6 GHz band, the Austrian regulatory authority wishes to remind participants that the tender documentation published on April 21, 2010 (especially Section 1.3.) contains stringent and detailed provisions regarding collusive behavior in the course of the procedure. In particular, such behavior includes the following activities:
- Cooperation among applicants with the intention of influencing the events or results of the auction;
- Public announcement of participation in the auction;
- Public announcement of bid amounts or bidding strategies.
These provisions are also applicable during the period leading up to the auction procedure. Collusive behavior may ultimately lead to the exclusion of participants from the auction.
